email him and see whats up.
If he doesn't have the product to ship that he has sold he is going to be in a little trouble anyway.
(Watermarks on pictures help with these issues)

I love the photos he used for eBay are the same backgrounds a your photos.

Hey, Chris I'm not sure if you go on PirateFarmToys at all but their forum has a section just for E-bay deadbeats, buyers and sellers, it's just a list that has been compiled by the forum members who do alot of business on the bay. or for advice in certain situations that seem to arise between buyers and sellers. Next time I log on over their I can have a look and see if this seller is on any of their lists.

I have a friend that is 15miles from there. He always says Sabetha is full of morons. I am going to pin this post and if anyone has ebay trouble put it in here.
